How does a criminal defense attorney set fees? That varies for each attorney based on several factors: the attorney’s experience, is the attorney in need of clients, what is the attorney’s overhead, where is the case located in relation to the attorney’s firm location, what are the charges, what is the client’s history, how does the client present, is the client going to need a lot of hand holding, and similar factors. Most criminal defense attorneys use a flat fee – the client pays one fee. It does not matter if the case settles early or goes to trial, the client is paying only one fee.
I am able to set my fees lower than what I hear is the going rate for various crimes despite having more than 15 years of experience. The reason is that I keep my overhead low to the benefit of my clients. Additionally, as only practicing criminal defense I am familiar with the law and process which allows me to set my fees lower as I will not have to spend time on your case getting up to speed on the law or process.
