OAS for OUI Suspension

If your license is suspended for an OUI or OUI offense and your within the original suspension period you will be charged with OAS for OUI suspension.  An OUI offense means an OUI conviction or suspension for failure to submit to a test.  If you are under suspension for an OUI or OUI offense and convicted of OAS the following mandatory minimums apply:

  • First OAS for OUI suspension – 7 days in jail, $600 fine, and a license suspension of not less than 1 year nor more than 3 years consecutive to the original suspension;
  • Second OAS for OUI suspension within a 10 year period – 30 days in jail, $1,000 fine, and a license suspension of not less than 1 year nor more than 3 years consecutive to the original suspension;
  • Third OAS for OUI suspension within a 10 year period – 60 days in jail, $2,000 fine, and a license suspension of not less than 1 year nor more than 3 years consecutive to the original suspension;
  • Fourth or more OAS for OUI suspension within a 10 year period – 6 months in jail, $3,000 fine, and a license suspension of not less than 1 year nor more than 3 years consecutive to the original suspension.  A fourth or more OAS for OUI suspension is a Class C Felony.
