What is the difference between a civil OAS and criminal OAS?

Click here to see the law on Operating After Suspension.  A person commits a traffic infraction of operating while license suspended if the person has not been convicted or adjudicated of a prior OAS and the sole basis for the suspension is:

  1. failure to pay a fine;
  2. failure to pay a license reinstatement fee; or
  3. Suspension for a dishonored check.

If your suspension is based on any other reason or you have a prior OAS conviction you will most likely be charged with a criminal offense.
